I. Purchase of API Integration. If you are using the vehicle inspecter site to purchase API integration as an employee, representative, or agent of a motor vehicle dealership, manufacturer, or other business entity, you acknowledge and agree that you are bound by these terms and are purchasing wholesale quantities of vehicle inspecter Data or vehicle inspecter reports (“Reports”) for use or resale. Accordingly, your use of such Reports must strictly conform to the following guidelines. vehicle inspecter makes no representations regarding the quantity, sufficiency, or quality of Reports provided to you. Purchases of Reports are non-cancellable, and fees paid are non-refundable. You are not authorized to use any Reports that have not been fully paid for.

II. Authorized Use and Purpose of Reports. You are granted a limited, revocable, non-transferable, and non-exclusive license to access and use Reports solely for your business purposes, specifically for the acquisition or potential acquisition of used vehicles primarily for retail sale (“Permitted Use”).

III. Restrictions on Access and Use. You shall not:

1. Cause, permit, or authorize the decompilation, modification, disassembly, or reverse engineering of the Site, or create derivative works thereof.
2. Sell Reports or information derived from Reports.
3. Share usernames and passwords with any person or entity (except with vehicle inspecter and vehicle inspecter -approved third-party vendors to facilitate the Permitted Use).
4. Use or permit the use of the Site, Reports, or any information derived therefrom in the operation of a credit bureau.
5. Use the Site or Reports for anything other than the Permitted Use.
6. Recreate, compile, or integrate Reports with other data.
7. Disseminate the Reports in any way other than to perform the Permitted Use.

You shall not provide the Reports or the data derived from the Reports, in whole or in part, to any competitor of vehicle inspecter. Systematic access or retrieval of Reports, including but not limited to the use of “bots” or “spiders,” is strictly prohibited. If you provide a Report to another party, you will not:

• Use or allow the use of the Site, the Report, vehicle inspecter Data, or information derived from the Site or Reports for any unlawful purpose or in violation of any applicable laws.
• Provide the Report or information derived from it for resale or remarketing purposes.
• Modify the Report in any way.

You shall not make any representation or provide any warranty regarding vehicle inspecter , the Site, or the Reports that is inconsistent with the provisions hereof and the information contained in the Reports (including all disclaimers).

IV. Reports Compliance. It is your sole responsibility to familiarize yourself with all applicable laws and regulations regarding the receipt, use, storage, and safeguarding of consumer data that we provide to you, and to fully comply with them. You agree to maintain reasonable physical, electronic, and procedural controls to protect any consumer information received pursuant to this agreement from unauthorized use or disclosure, ensuring that access to the consumer data is restricted solely to the purposes for which the information was disclosed.

V. Disclaimers; Limited Liability. You acknowledge that vehicle inspecter collects data from public records and other sources, and this data may contain errors and omissions. vehicle inspecter does not guarantee the correctness or completeness of the Site or the Reports and will not be liable for any loss or injury resulting from the procurement, compilation, collection, interpretation, or availability of the Site. You understand that not all information is available for all states, and vehicle inspecter may not have access to certain information available to other parties. You also acknowledge that there may be a delay between the receipt of certain information by vehicle inspecter and its inclusion in the Reports. The Site does not provide conclusions regarding the condition of any vehicle, and you assume full responsibility for decisions and transactions based on the Site. VEHICLERESULT MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY THAT THE SITE WILL FUNCTION WITHOUT INTERRUPTION OR ERROR, AND EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. You agree that vehicle inspecter liability for damages, regardless of the form of action, shall not exceed the amount paid by you for the individual Report. In connection with the vehicle inspecter API Service, you understand that vehicle inspecter provides Report information “AS IS” and “AS AVAILABLE” and will have no liability for any information associated with the vehicle inspecter API Service, including, without limitation, the accuracy or completeness of the inventory information or for non-compliance with applicable federal or state laws.
